The ‘Company’ shall mean Up Abroad (Up Abroad Limited). The ‘client’ or the ‘student’ shall mean the person in whose name the booking is made and shale include the person or persons on whose behalf the same is made.
These terms and conditions apply to courses available on www.upabroad.com.
By enrolling, you accept the contract and terms and conditions of Up Abroad Limited.
Once we have received your enrolment via email or post, we will confirm your language stay within 7 days. If the course you have chosen is full, we will inform you as soon as possible and offer an alternative course. We recommend that you book your flight/train ticket once you have received your booking confirmation from our admissions centre.
Up Abroad act as a booking agent for the relevant supplier of any language course or product that we sell.
No contract is made between the company and the client and no booking is valid until the company has issued a confirmation e-mail. An e-mail acknowledging receipt of an order does not constitute a confirmation. The company will issue a confirmation after it has received a completed online booking form, a €250 course deposit and availability of the course has been confirmed by the school. If the booking is made by telephone, the agreement is legally binding once the booking details have been taken by the company and once the €250 course deposit has been received by the company and written confirmation sent to the student. The due date of full payment is 45 days prior to departure date.
If the full balance of the order is not paid by the due date the company reserves the right to cancel the client’s booking and to impose the cancellation charges, stated below.
Deposit of €250 is required for bookings made more than 45 days before the course is due to start. The remainder of the fees is due no later than 45 days before the start of the course.
You can book you course less than 45 days before you are due to start. In this case you will pay the deposit and then pay the balance as soon as your booking is confirmed by us.
Charges are sometimes made for registration fees, course materials, examination fees and excursion/activity fees. Seasonal surcharges may also apply to certain courses or types of accommodation. Please contact us for details.
Credit/Debit card We accept payment by Visa and MasterCard in all currencies.
Bank Transfer Bank transfer payments are accepted in Euros and Pounds Sterling. Our bank details will be listed on your invoice. Please ensure that we receive the full amount required, free of any sender or intermediary bank charges.
Cheque Cheques in Euros should be made payable to ‘Up Abroad Limited’.
If the client wishes to cancel their booking this must be done in writing by the person who completed the booking. The day that notification is received in writing by the Up Abroad office is the official cancellation day We reserve the right to apply the following cancellation charges:
· 60 days or more prior to the departure: deposit only
· 59 to 45 days prior to the departure: 20% (if greater than deposit)
· 44 to 15 days prior to the departure: 30%
· 14 to 8 days prior to the departure: 50%
· 7 to 1 day(s) prior to the departure: 80%
· From the first day of your stay or in the case of an early return, no refund will be granted.
If the client wishes to change details of their reservation after the confirmation invoice has been issued, they must provide a written notice to the company at least 28 days before the start of the course. It is not possible to amend a course after the date on which a student is due to move into their accommodation or start their course.
Amendments can be subject to a €50 charge plus any additional charges imposed by the school.
The organiser may cancel a programme in the case of unforeseeable circumstances, by order of local authorities, a strike, natural disaster, unrest or other restrictive reasons. The total amount paid for the course will be immediately returned; however, in all cases, the company reserves the right to keep compensation for the services partially provided.
Where accommodation is shown for one week, this means 6 nights from the Sunday before a course starts until the Saturday after it finishes, unless otherwise indicated. Please note the check in and check out times of the accommodation you have booked. If you spend less than 6 nights in your accommodation in any particular week, you will not receive any discount. Extra nights can be arranged according to availability and for an additional fee. Please check the rules and regulations specific to the school and accommodation that you have booked.
The contact details of the host family (name, telephone, full address) will be communicated to you by email around 7 days prior to your departure. It is possible that a last-minute change can take place for reasons beyond our control. Requests concerning the distance from the school, the presence of children and the presence of domestic animals are not guaranteed. If the student is on a special diet, follows medical treatment or suffers from any allergies, our Admissions Centre must be informed before the start of the programme so that the school can guarantee suitable accommodation.
Classes at our partner schools run from Monday to Friday, starting on Mondays (except when Monday is a public holiday). Classes usually last between 45 and 60 minutes and the exact lesson length is given under each school’s entry on our website.
According to the number of participants, their language level or the season, our partner schools are sometimes obliged to replace booked group courses by one-to-one classes (of fewer lessons). These changes do not give way to any refund.
Most students, except complete beginners, will begin their course with a level test on the first Monday, after which they will be placed into a group suitable for their level. Some of our partner schools ask students to complete an online level test before they arrive.
If the client who applies for a course requiring a specific level, is found to not to have the appropriate language level after completing the initial test, the school may offer an alternative course, or private lessons.
The descriptions of activities and excursions presenter in our brochure or online and offered at our schools are for guidance only, unless specifically noted in the confirmation invoice. Some activities may not run or may be substituted by other activities or may be subject to a minimum number of participants.
Please note that 1-week programmes may not include weekend activities.
Lessons will not take place on public holidays and are not-refundable.
Up Abroad cannot be held responsible for the impossibility of assuring the services initially planned by reason of failure of its service providers, conflicts, or serious problems outside of its control. Up Abroad is responsible for the authenticity of its brochure, the accuracy of its content, the conscientious choice of the service providers as well as the passing on of travel documents to the point of sale/client. Up Abroad can in no case be held responsible in the case of an accident in the place of the stay or during the journey. Only the responsibility of the service provider (school, …) can become involved. Up Abroad cannot be held responsible for any possible changes to the programme (courses, classes, accommodation details, etc.) which its partner schools may be forced to make. Up Abroad reserves the right to change, without prior notice, the content of its brochure as well as the chosen service providers.
Students, and those accompanying students, are expected to behave in a courteous manner and to respect fellow students and staff at our partner schools.
In the event of any illegal activities, violation of the rules of the establishment or inappropriate behavior of a student, the company and the schools reserve the right to take any action we deem appropriate ranging from a warning or reprimand to a dismissal.
All fees, including the return journey, fines, etc. are at the expense of the participant or of the parents. The participants, or their legal guardians, are also responsible for any damages or losses caused during their stay.
Clients are responsible for taking out adequate insurance for their holiday.
The parties therefore agree that Up Abroad Limited shall under no circumstances be held liable and that is the responsibility of the student to take out whatever insurance may be deemed necessary to guarantee his/her personal belongings and property made available to him/her. Where students are minors, their parents or legal guardians shall assume all legal liability on their behalf and shall take out full insurance necessary on behalf of such minors.
The company reserves the right to refuse to accept bookings from clients who are not adequately insured against holiday risks. Clients may be asked to provide evidence of adequate insurance at the time of booking.
EEC Nationals should have an European medical insurance card which entitles them to national health insurance cover during their overseas stay.
Our prices do not include flights or other transport to our schools. Students must make their own travel arrangements and are responsible for obtaining all necessary travel documents, such as a valid passport and visa.
However, we do offer airport transfers in most locations, for an extra fee. We must receive full flight details at least 7 days before students are due to arrive.
Any complaint must be made directly to the school and to Up Abroad as soon as possible and during the duration of the stay. If the problem cannot be solved directly, you can demand a written report from the school and address it to us with your complaint, at the latest 7 days following your return. Any complaint made after this deadline is inadmissible.
This agreement shall be governed by and construed in accordance with Irish law and the parties irrevocably submit to the jurisdiction of the Irish courts to settle any dispute which may arise in connection with this agreement.
